Guest fx
Judge orders CPS to disclose more information http://kvoa.com/Global/story.asp?S=6849644&nav=HMO6HMaY A harsh decision is handed down by a judge against Child Protective Services. It's all tied to the files on three Tucson children murdered earlier this year. Detectives say Ariana and Tyler Payne were murdered by their father and his live-in girlfriend. Ariana's body was found at a Tucson storage facility back in February. Tyler's body has never been found. Brandon Williams died from blunt force trauma to the head. His mother and her friend are charged in his case. All three of these children were once under CPS supervision. CPS released limited summaries touching on the events that led-up the deaths of these children. But it wasn't enough. Now, a judge wants the public to know more about those children-much more than the state wanted to release. We told you about the courtroom battle Monday: two Arizona newspapers taking CPS to task up in Phoenix, for the files on 4 year old Ariana and 5 year old Tyler Payne, as well as the paperwork on 5 year old Brandon Williams. With regards to the Payne file, Judge Edward Burke slammed the state for over-redacting the children's paperwork; blacking-out too much information and providing too many duplicate pages. The judge said that "made unnecessary work for the court and might cause a cynical observer to both question the state's sincerity and wonder whether a 'gem' might be 'buried' in the pile..." With regards to Brandon Williams' file, the judge was also critical, saying, "The overwhelming majority of the records deal with Brandon Williams' two older siblings who have no involvement with his unfortunate death." He ordered CPS to go back to the drawing board to release more information than it offered, which will include Brandon's complete autopsy report. The attorney general's office made it a point to tell the judge on Monday that it takes quite a bit of time to go through the files and omit information for privacy sake. Based on Thursday's order, the attorneys will, basically, have to start from scratch. As soon as News 4 has the files, we'll let you know.
