Woman says Penn State running back forced himself on her in his apartment.

As they walked back to his place, she told Austin Scott she wasn't going to
have sex with him. Girls always say things like that, he told police, but
often change their minds.

The woman fell asleep with her clothes on but woke up with her jeans off and
Scott trying to force himself on her, according to court papers. When she
tried to get up, the papers say, he punched her in the kidney and pinned her
down as he raped her.

Scott, who was one of the most celebrated high school football players ever
in the Lehigh Valley and has gone on to a checkered career at Penn State
University, was charged Friday with raping the woman in his campus apartment
in the early morning hours of Oct. 5.

The 2003 graduate of Parkland High School acknowledged having sex with her
after meeting her for drinks at a popular State College bar the night
before, but told police it was consensual.

A probable cause affidavit says the Penn State running back told police
"girls will say that they do not want to have sex with you, but then they
get to your room," things heat up and they reconsider.

Scott, 22, who earned All-American honors after leading Parkland's Trojans
to a state championship in 2002, was suspended from the Nittany Lions hours
after the woman left his apartment. That day, Coach Joe Paterno announced
Scott was barred from playing for an unspecified violation of team rules.

On Friday, university officials confirmed Scott, who is free on $50,000
unsecured bail, remains enrolled but said little else.

"As Coach Paterno stated earlier this week, [Scott] has not participated
with the team since the end of last week," athletic department spokesman
Jeff Nelson said. "We do not anticipate any further comment."

According to the affidavit:

Scott told police he met the woman a couple of months ago, but didn't seem
to know her name during an interview. He referred to her as "this girl."

They talked periodically and met once for pizza. They agreed via text
message to meet Oct. 4 at The Saloon, a bar in downtown State College. The
woman told police she had a few mixed drinks that night.

She agreed to go back to Scott's room on-campus in the Nittany Apartments,
but said she told him on the way she didn't want to have sex.

"Just so you know, I am not going to have sex with you," the woman said she
told Scott.

"Do you want me to call you a taxi now?" she said he answered.

She later asked him to "respect me and my wishes."

He agreed, she said, but later asked: "If I can't have sex with you, can I
at least cop a feel?"

At his place, they lay on his bed and watched TV. She said she took her
shoes and socks off, but otherwise remained clothed. She said she had
difficulty staying awake and eventually fell asleep.

She told police she woke up early Oct. 5 to find her jeans off and Scott was
trying to have sex with her through her underwear. She started to sit up and
felt what she believes was a punch to her back, by her right kidney.

She told police she lay back down and "went along with it because she was
afraid [Scott] was going to hurt her."

The woman said Scott pulled her shirt to expose her breasts, took off her
underwear and had sex with her. During intercourse, she said, she felt Scott
holding her arms down with his hands. She said he was saying "really gross
things."

"You're really hurting me," she said she told Scott at one point. "It really
hurts."

He continued until he ejaculated, then fell asleep.

The woman tried leaving the apartment while he slept, but he woke up when
his cell phone went off. She told him she could not sleep there, they
embraced and she left.

She started to walk off-campus, then called a friend. The friend contacted
police.

The woman said she later got a text message from Scott: "R U OK?" She didn't
respond.

Later that day, police met with Scott on campus. He told police he'd spoken
with the woman earlier that morning, and she said she wanted to talk to him
about hitting her and bruising her the night before.

He said he told her that he didn't know what she was talking about.

Scott said he'd been at a fraternity party before meeting the woman at The
Saloon. She told him on the walk to his apartment that she didn't want to
have sex, and he said he thought "if she doesn't want to hook up, then we
won't hook up."

He told police he later had sex with her, but he believed she had consented.

Scott was arraigned Friday by State College District Judge Ronald Horner on
charges of rape, sexual assault, two counts of aggravated indecent assault,
two counts of indecent assault, and one count of simple assault.

The preliminary hearing is scheduled for Wednesday.

Scott declined to comment after his arraignment, but his lawyer said the
player will be cleared.

"The interaction he had with the woman involved was consensual, and we
anticipate we will be able to prove that in court," attorney Joseph Amendola
said. "Very optimistic. We're looking forward to the opportunity of
establishing his innocence."

Scott's mother, JoAnn Scott, answered the door Friday night at the family's
home in Price Township, near East Stroudsburg. She said her son was not at
home.

"We fully stand behind our son," she said. "He'll be proven to be innocent."

Bill Mahon, Penn State's vice president for university relations, said
administrators haven't seen the police report. The university can suspend
students, but he declined to speculate whether that would happen to Scott.

"That we won't know until we look at the evidence," he said.

Scott's arrest is already drawing widespread attention, with comments on
some Internet sites comparing the charges against him to the case of three
Duke University lacrosse players who were accused of raping a stripper.
Those players were vilified by many, but the charges were later dropped.

Fresh off his Parkland career, Scott arrived at Penn State in 2003 and led
the team in rushing his freshman year. Nagging injuries contributed to a
spottier performance since then.

A fifth-year senior, he ran for 302 yards and six touchdowns this season
before he was suspended.
