BUENA VISTA, Pennsylvania (AP) -- A 13-year-old girl used a shotgun to
fatally shoot her father in the head early Monday in a home overrun
with animals and filth, police said.

The girl told investigators she used a 12-gauge shotgun to shoot
34-year-old Matthew Booth in the face while he was in bed, according
to a police affidavit.

A police complaint did not identify a motive in the killing, but her
mother, Michelle Fazek, who was separated from Booth, said she had
complained several times to county child welfare officials that her
daughter and her brother, 14, were living in squalor and that her
daughter had been abused.

"I just want to see her," Fazek said. "She must be so scared."

Messages left for Allegheny County's Office of Children, Youth and
Families were not immediately returned.

The Associated Press does not identify victims of possible sexual
abuse.

The girl appeared in municipal court late Monday wearing a maroon
county jail uniform, her hands and ankles cuffed, where she was
charged as an adult with criminal homicide and ordered held without
bail.

The house in Elizabeth Township, about 20 miles southeast of
Pittsburgh was in deplorable condition, police said.

"They had a number of animals, dogs, cats and rabbits. They hadn't
cleaned up after them," said James Morton, assistant superintendent of
Allegheny County Police. The two-story frame house had dirty, peeling
white siding, and a downstairs window was boarded up.

This will be a near-impossible defense for the girl's lawyer.
Shooting some guy when he's laying in bed and you're not in bed isn't
at all likely to be ruled self-defense or justifiable homicide. Prior
cases where kids killed alleged pedophile parents - with the kids
using everything from baseball bats to guns - didn't go well for the
kids.

Her age and psychological circumstances must be taken
into account. What are "obvious" alternative solutions
for an adult may not even enter the brain of a badly
abused 13 year old girl.

He DID love the Va.Tech shootings, didn' he ? :)

Guess he just can't STAND it when guns are put
to a useful and just purpose.
 
I question the whole story. Why didn't the mother have custody?
Who actually owned all the animals ?
Did he threaten to get rid of the kids pets so they killed him?
Lets hear the rest of the story before we condemn him or her.
The truth may never come out now because he wasn't allowed to speak
and defend any allegations against him.
You guys fly right off the handle before the truth comes out. Sounds
like a lynch mob based on accusation.

No judge, nowhere, will dismiss as self-defense shooting a guy
lying in bed when the shooter isn't also in that same bed at that same
time. Whether or not the jury will O.J.-style "jury nullify" the case
is another matter - but prior such cases involving kids claiming
molestation by parents they killed haven't gotten the kids off, even
with credible documentation that the parent was an abuser. The kids
in such cases have used weapons ranging from ball bats to figurines to
- of course - guns, but none I'm aware of got off. The cases have
been in states as varied as Massachusetts and Oklahoma.

First off, there is NO proof in the article that there was ANY abuse,
let alone sexual abuse by this father. When allegations were made to
authorities they obviously found no evidence of any. The worst "abuse"
mentioned is a dirty house where pet feces were not cleaned up.

Lessee. Cat takes a dump on the floor outside it's box so I take a
shotgun to my dad to find "justice"! Oh wait. I don't just take a
shotgun to my dad, I plot PREMEDITATED MURDER by waiting until he is
in bed. And you find this case a WONDERFUL expression of your view of
a "fair" society! You are clearly insane! In fact, as you are
advocating premeditated murder, I'd say you are CRIMINALLY INSANE!

I'm sure in your deranged, drug addled, mind you see yourself as being
some kind of hero on a white horse, standing up for little girls,
fighting child abuse, and using lethal force to impose your idea of
justice on an unwilling world. The rest of the world (including your
therapists, to whom you should listen more) however, sees you for the
sicko that you really are.

Have you done your part to stop gun violence by adding your name to
the list of those who volunteer to be banned from gun ownership for
life? Society will be MUCH safer if you do.

For those of you lurkers not yet insane. Please allow me to draw you a
picture of the difference between self-defense and premeditated
murder: You put the shotgun under your bed. Daddy comes to "visit"
with his John Thomas hanging out. You shoot him. THAT is self-
defense. You wait until he's in bed and then go kill him. THAT is
premeditated murder. Oh sure we've all seen the made for TV movie
where the woman gets acquitted after shooting an abusive husband
sleeping in bed. But here's a hint: TV movies from La La Land ain't
real life!

Sorry, but I do have a certain respect for "street justice".
It's often more accurate and appropriate than the horrible
bureaucratic 'justice' system we've created. Here we had a
case of the victim taking direct action against her attacker.
If I was on the jury, I'd give her a pass on this one ...

The defense would probably be temporary insanity as in Francine Hughes AKA
the burning bed case, not self defense.

I don't know what a "good" molester is but lots of molesters go to jail
because there is lots of good evidence against them. There may be in this
case too but I haven't heard about it yet.

How quickly the case here in Tennessee has been forgotten. A preacher's
wife shot her husband in the back of the head with a shotgun while he was
asleep. She then took their 3 girls and fled. One of the girls is old
enough to remember this the rest of her life, the other two, a toddler and
an infant hopefully will not.

The judge, prosecution, and the jury all bought her story of sexual abuse.
She's either the world's best non-professional actress or she was telling
the absolute truth. Reality probably falls somewhere in between. At worst
she'll serve 4 1/2 years. She's currently fighting for the custody of her
daughters. Personally I hope she loses. Google Mary Winkler.

with ******s being railroaded into jail. As I recall the line was
"well that ****** might not have been guilty of THIS crime but a
conviction is OK since we all know he is probably guilty of SOME
crime!"

Who needs "justice" when cases can all be decided by you personal
opinion of the guy without reference to any evidence. "Oh, he just
LOOKED guilty!" You are a piece of work!

Want to bring back the "good old days" I take it. Hell, why wait for
the courts. If she hadn't killed her father, a bunch of us "good ole
boys" should have just taken a rope over there.

defense" by the victim, not a perversion of the system.

You know I am getting kinda sick of hearing this, I have yet to see
anything, anywhere stating that America, The UK or anyone else involved
in this war has taken any oil from Iraq. All I have heard is how much we
are paying for it. If we went to war over oil, why is it do damn expensive?
