Guest Patriot Games Posted June 16, 2007 Share Posted June 16, 2007 http://www.sequoyahcountytimes.com/articles/2007/06/14/news/fronth.txt Sallisaw woman shot ex-husband in self-defense, police believe Wednesday, June 13, 2007 The Sallisaw woman who shot and killed her ex-husband early Friday morning after he broke into her home and assaulted the woman and her boyfriend with a bat may have thwarted her ex's alleged plans to kill her after police discovered that the man allegedly brought a bag of butcher knives into the woman's home. According to Sallisaw police, the man, Robert Wolfe, 49, broke into his ex-wife's home, located at 603 E. Zulkey in Sallisaw, between 1 and 1:35 a.m., knocking glass out of the back door. Wolfe's 33-year-old ex-wife, Kimberly Wolfe, and her boyfriend, Timothy Sizemore, were asleep in bed when Robert Wolfe allegedly began hitting the two with a baseball bat that he was swinging. Kimberly Wolfe retrieved her gun and fired three shots, two of which went through the bedroom wall and one which fatally wounded Robert Wolfe, police said. Sallisaw Police Chief Shaloa Edwards said they later discovered a bag of Dexter butcher knives that Robert Wolfe allegedly carried into the home. Edwards speculated that Robert Wolfe had planned to first torture his ex-wife before killing her. The Oklahoma State Bureau of Investigation (OSBI) was called to the scene to investigate the shooting. Jon Loffi, OSBI assistant director, said Tuesday that the agent investigating the shooting has pretty much wrapped up the case. Once the agent's report is complete, Loffi said the OSBI will present the facts to the Sequoyah County District Attorney's office and let them make the call on whether charges will be filed. On whether charges would be recommended, Loffi said the appearance of the shooting is that it was an act of self-defense. Kimberly (Wolfe) Davis has not been arrested. "It had all the appearances of a heat of passion type thing," Loffi said. The OSBI was releasing limited information about the shooting. Loffi confirmed that there was forced entry in the back door of the home and Robert Wolfe assaulted the couple with a bat. When asked if any other items were found in the home, Loffi said there also could be some things that they can't yet disclose until the agent's report is complete. Both Sizemore and Kimberly Wolfe were treated and released for injuries. Edwards said Sizemore, 45, was expected to see an orthopedic surgeon because his elbow was shattered and his hand was broken. Robert Wolfe also struck Sizemore in the side of the face and ribs. Kimberly Wolfe did not suffer any broken bones, he said. Sizemore received the most trauma because Edwards said it was believed that Sizemore was on the side of the bed facing the bedroom door. Kimberly's teenage daughter was also in the home and was discovered hiding in a closet in another bedroom. According to the Sallisaw police's initial report, Kimberly Wolfe was on the porch of her home when police arrived, yelling that her ex-husband had broken the glass out of the back door and came into the bedroom and began beating her and her boyfriend with a bat. The woman told police that while Robert Wolfe was hitting the couple, she grabbed her gun and shot at him. She said he kept beating them so she shot at him again. When he continued hitting them, she fired a third shot and Robert Wolfe fell to the floor. Officers reported observing glass broken out of the back door. Officers walked into the bedroom and saw Robert Wolfe lying in the floor on his left side. He had no pulse. One officer saw what appeared to be a bullet wound on Robert Wolfe's forehead between his eyes, according to the report. Edwards said the divorced couple had been in a long dispute, and the woman had protective orders against her ex-husband. Court records indicate that the couple had been officially divorced for less than a month. Kimberly Wolfe filed for a divorce in July 2006. The divorce decree was granted May 16. According to court records, Kimberly Wolfe filed for three protection orders against her ex-husband in July and December 2006, one of which was dismissed. Robert Wolfe had also filed for protective orders against Kimberly Wolfe in July 2006 and April 2007, both of which were later dismissed.
