Lawsuit accuses AG's office of hindering investigation

A lawsuit filed in Phoenix on Monday accuses Arizona Attorney General
Terry Goddard of trying to impede an investigation into the prosecution
of former state treasurer David Petersen.
The Maricopa County Sheriff's Office is investigating whether a $1.9
million payment made by the treasurer's office to Goddard's office for
legal fees last year was part of an arrangement to secure leniency for
Petersen, who was under criminal investigation at the time.
Monday's lawsuit, filed by the Maricopa County Attorney's Office,
alleges that Goddard has attempted to delay the sheriff's investigation
and become privy to investigators' strategies.
The suit says he did that by retaining an attorney, Edward Novak of
Quarles & Brady LLP, who "demanded" he be notified of any interviews
sheriff's investigators plan to conduct with employees at the attorney
general's office.
"This demand, if honored, would have the potential of intimidating
employees of the (attorney general's office) from candidly providing
information to investigators and would reveal investigative strategies
to the subjects of the investigation," according to the lawsuit, filed
in Maricopa County Superior Court.
Maricopa County Attorney Andrew Thomas also alleges that by making such
demands, Novak has been acting like Goddard's personal criminal defense
lawyer at taxpayers' expense.
Andrea Esquer, a spokeswoman for the attorney general's office, said no
one at the office can comment on grand jury investigations. She released
a statement saying the office will "continue to cooperate with this
investigation" and that Novak was retained to represent the attorney
general's office, not any one individual.
Novak also said he was unable to comment because of the grand jury
investigation.
Goddard has said the $1.9 million payment from the treasurer's office
was mandated by law and in no way influenced the handling of Petersen's
case.
His office said it received the payment for legal work to recover state
and local government investments with National Century Financial
Enterprises. The Ohio-based health care financing company collapsed in
2002 amid a federal fraud investigation.
Monday's lawsuit asks Maricopa County Superior Court Judge Anna Baca to
declare that the sheriff's office be allowed to interview or contact
employees of the attorney general's office without notifying Novak.
Petersen, a Republican and a former state senator who was elected
treasurer in 2002, resigned in November under a plea agreement with
Goddard, a Democrat.
Petersen pleaded guilty in October to a misdemeanor charge of failing to
report outside income while in public office. He was fined and placed on
probation.
The guilty plea capped a monthslong criminal investigation into
ultimately unproven accusations of misuse of public money.
Petersen was charged only with the single misdemeanor charge of filing a
false or incomplete financial disclosure statement in connection with
$4,200 in commissions he received for selling character-education
materials to schools.
