A woman whose husband was once incarcerated at the Mesa County jail has filed a claim of at least $100,000 against the county, saying jailers distributed nude photos she'd sent him. Jessica Duran filed the claim Tuesday through Denver attorney Lonn Heymann. Such a claim is required before the plaintiff could sue. Duran says her privacy and civil rights were violated, and that she has suffered emotional distress and humiliation. County officials say it's standard procedure to open inmates' mail to prevent contraband from getting into jail. Duran says jailers distributed the photos without her knowledge or permission, or that of her husband. Sheriff Stan Hilkey says any lawsuit against the county in this case would be meritless. In my opinion, I think anyone who files these suits should be subject to a penalty of some kind if proven to be without merit. In my opinion, I think anyone who files these suits should be subject to a penalty of some kind if proven to be without merit. If a woman takes nude pictures of herself and sends them into a prison, she cannot have an expectation of privacy. I believe that the best way to stop frivolous lawsuits would be to make the loser pay the legal bills for both sides. As for the expectation of privacy, she may have thought she had it but it's pretty common knowledge that mail into a jail or prison is opened to screen for contraband. If the photos were contraband, they should have been seized and placed in the person's property for when they got out or disposed of. If they were in fact passed around to other staff members, it probably wasn't the smartest thing in the world to do, but not worth $100,000. I think she would have to prove some kind of damage to her character as a result and if she's taking pictures of herself nude and sending them through the mail, I don't think her character would be damaged any more then she has done to herself.
