Ore. judge order state to bail out rape suspect 12/12/2008, 12:22 a.m. PST The Associated Press OREGON CITY, Ore. (AP) — A Clackamas County judge has ordered the state Department of Human Services to bail a rape suspect out of jail so he can help plan care for his junior-high age son. Judge Deanne Darling's order, obtained by The Oregonian newspaper, directs "DHS to post bail or otherwise assist father in being freed from jail." The order does not say why Darling believes Russell Hamblen must be let out of the county jail to participate in planning discussions. Clackamas County has a closed-circuit television system and the sheriff's office often takes inmates to court hearings without releasing them from custody. State attorneys will ask the judge next week to reverse her decision. Department of Human Services officials say the agency lacks the authority to post Hamblen's bail, which is set at $500,000. "It wouldn't be an appropriate use of funds even if we did," said Gene Evans, an agency spokesman. Ore. judge order state to bail out rape suspect - NewsFlash - OregonLive.com A judge orders a state agency to pony up half a million dollars to bail out a guy that worked with his older son to get teenage girls drunk and rape them, so he can take care of and mentor his 13 year old son. phreakwars Posted December 16, 2008 Posted December 16, 2008 First of all, the judge is NOT a Liberal: Candidate Detail (nice try). Second, that was a crazy decision to do so. what the hell, let the guy out to care for the 13 year old?? NO WAY !! Tough sheeeet, what if the guy was accused of murder? . . ImWithStupid Posted December 16, 2008 Author Posted December 16, 2008 First of all, the judge is NOT a Liberal: Candidate Detail (nice try). . On what are you basing this? I didn't say she was a Democrat. Many states, and it appears Oregon is one of these states, don't allow judges to have a party affiliation like those in the legislature in Nebraska. Quote
phreakwars Posted December 16, 2008 Posted December 16, 2008 Same reasoning your using to say she is a Liberal. Don't know what your basing that off of. You more or less, just want to label her. . . Quote https://www.facebook.com/phreakwars

Anna Perenna Posted December 17, 2008 Posted December 17, 2008 I don't see how labeling the judge as a liberal makes any kind of point. This ruling is terrible. End of story. Perhaps you should concentrate on protesting the action rather than using it as yet another excuse to bash liberals. LAME. hugo Posted December 17, 2008 Posted December 17, 2008 From some article: ?It just sounds too good, doesn't it?? said Darling, the juvenile judge. ?She is just one of those once-in-a-lifetime people.? Darling wrote a poem about LeBarron in 2001. In the closing line, she called LeBarron her hero. She wrote a poem that makes her a liberal. phreakwars Posted December 17, 2008 Posted December 17, 2008 What I want to know is what qualifies as a "LIBERAL" ruling by a judge. And I really hope the comeback isn't "THIS CASE" because I think a presidence would first need to be set by a confirmed Liberal party that would agree that this was an appropriate call in the first place. I mean, any time a guy is called a conservative judge, it's probably a gun issue. So what make's this ruling Liberal? . . Quote https://www.facebook.com/phreakwars

I mean, any time a guy is called a conservative judge, it's probably a gun issue. So what make's this ruling Liberal? . . Gun issues and civil issues aside. Just in criminal cases, I think a good guideline for whether the ruling may be considered as liberal, would be a case where the ruling, appears to take the welfare or interest of the defendant over the safety or concerns of society, except in an obvious, clear cut, case of legality/constitutionality. IMO. This ruling was obviously a judgement call, and has the appearance of disproportionately favored the defendant over society. It wasn't a guy who made a bad decision once. The guy actively planned and sought out teenage girls to get drunk and have sex with, and recruited the help of his son. I think a reasonable person would believe he posed a threat to society. Another example I would cite would be that of the judge in western nebraska who raped a 12 year old girl but refused to sentence him to prison because he was too short. This was considered a "liberal" ruling. So liberal in fact, the ACLU didn't even agree with that one. Quote
phreakwars Posted December 18, 2008 Posted December 18, 2008 So what are you saying, that any case that proves to be disproportionately favoring the defendant over society is Liberal? And what exactly is so wrong with that? You can't give EVERYONE the death penalty for their sins against humanity. . . Quote https://www.facebook.com/phreakwars

I think you may have glossed over this part of my comment... a case where the ruling, appears to take the welfare or interest of the defendant over the safety or concerns of society, except in an obvious, clear cut, case of legality/constitutionality In this case letting out a predatory pedophile, so he can be part of the decision process of his teenager, puts societal welfare at risk. They said his mother couldn't do it because she got a DUI and has substance abuse issues and can't make responsible decisions. I guess someone who actively planed a conspiracy to, lure, drug and rape children with their son has shown they are better at making responsible decisions then the alcoholic? Come on. I'm sorry if I or those on the "conservative" side think it's a better bet to allow the drunk make a decision then the predatory pedophile run free. Quote

I don't understan why you would ask for a serious answer or definition of what qualifies a decision as liberal or conservative, and then make a completely baseless statement about a political party. I didn't even bring up a political party in this thread. Quote
