I'm representing a friend in a case at his school. He was accused of (and has pleaded guilty to) posing as a professor to receive free textbook evaluation copies. Since I enjoy challenges, I have volunteered to help him in his defense.

 

My current stance involves a sypmathetic plea to the committee. Since the textbook company has accepted his apology, and wished him luck, that's not the problem. The crux of the issue is his posing to be a professor at the university he is studying at. His university will come up with a verdict that could range from informal probation to formal probation to suspension (with expulsion as very remote possibility). Since there has been no simillar case, this one might set some sort of precedent. The person who filed the claim filed it as fraud.

 

I'm wondering what this group of debaters would recommend?

A few things to note:

1. This person contacted the textbook company and apologized, admitting his true status as a student, before the company even sent him anything. Therefore, he hasn't unrightfully "taken" anything.

 

2. The textbook company has forgiven him and wished him luck in any proceedings.

 

3. He has already spoken with a committee member and expulsion is likely not an option.

 

4. This student sincerely accepts that he made a mistake and admits to not really realizing that he was committing fraud at the time when he submit the request. He only recognized the ethical considerations of exploiting the company's policy, for which he later apologized and "turned himself in" to the company. (Though it is important to note that the company already knew he wasn't a professor because they had contacted the university.)

 

Lastly, please try to give some constructive advice. I'm trying to defend this person, and I already know how difficult the task will be.

If your coming to us for advice on how to defend that worthless piece of shit, cheap mother fucker, then the advice is simple... fess up to being a piece of shit, and throw yourself at the mercy of whoever it is you need to fess up to.. I do believe that was the very first bit of advice given here.

I'm trying to minimize his sanction. It's unlikely that he would get expelled, but it could mean the difference between suspension and probation.

 

Trouble with the police would definitely NOT be involved, and expulsion is very remote, especially since this person is a freshman.

I'll be frank with you, he sounds like an arrogant little shit and he deserves as severe a punishment as the school can give him. Maybe it will wake him up and make him walk a straight line in the future and NOT do something worse next time.

He already admitted his guilt, so what are you defending him against? If he wants to minimize his punishment, eddo has it right. Beg and plead and kiss some serious ass.

I'd say he's pretty smart and most likely will be a senator someday. He just did what rich people do everyday, screw someone over to get what they want. Kick him in the nuts for not going through with it, then grab a beer and a slut and forget about it.
