The suit, filed Tuesday in US District Court in San Jose, California., charges that the iPod music player can produce sounds of up to 115 decibels even though some studies suggest that listening to music at that level for 28 seconds a day can cause damage over time. Last year in Boston, some guy had his IPod volume so high that when he started to cross the street he did not hear the horn of a huge semi, which hit him a few seconds later and killed him on impact. I personally like the fact that it gets loud because sometimes I don't feel like wearing the headphones so I just put my iPod next to me with the volume all the way up and I can hear it just fine. But it's kinda like karma. iPods are probably the first thing that pops into peoples' minds when they hear the words "MP3 Player." They have low battery life, software problems, lacks features, and overall quality. Theres so many better alternatives out there like Sony and iRiver. But iPod is more popular because they have spent the most by far in marketing and their ambiguous designs. I own an iRiver-H10 (20 GB, color). The price is the same as the 4 GB iPod Nano (250). It doesn't require software like iTunes to upload songs, and 16 hours of battery life, which is 2 hours more from the Nano and Video ipods and twice as much as the 3rd generation iPods and the minis. Firmwire upgrades from the company directly to your iRiver if a problem arises or to tweek your player's performance. It has the ability to play FM radio and you can record from the radio as well. You can also voice record (LP/FM Concerts, school lectues) and Line-In record (My vinyl, protected CDs etc.) Much more formats supported on this device. It has a vertical touch strip to navigate your songs the easiest way possible, instead of rotating your finger 360 degrees around on the iPod. I don't really like big companies, but wow, it's not Apple's responsibility. People should just read the damn manual. And know that if you listen loud enough you can get hearing damage. Of course people can get caught in the moment and forget all about volume and hearing damage and start blasting music real loud, but that's not Apple's fault, that's for sure. Probably because I have a huge fetish with pink xD. I don't think the guy should blame ipod for his own fault though. It's like a kid's parent sueing Cadburys or a sweet compant because their childs teeth fell out >.< It's the responsibility of the consumer to use it sensibly. It's common sense that if you're exposed to very loud sounds, your hearing is obviously going to deteriorate. I don't really use my ipod on the highest sound setting myself.
