1. One does not even need to be convicted of a sex crime to be ordered by a competent court of jurisdiction to register as a sex offender. In fact, this is a common plea down tactic used by DA's and criminal courts in the USA. Given the life imprisonment of the BTK killer, I see no reason to debate the point which is clearly moot.

 

2. This country and the states themselves do not have the right to discriminate, however, they have the right to LEGISLATE laws and even enact DEPARTMENTAL POLICY with respect to convicted felons. This is a fact. That is why although the constitution guarantees the right to keep and bear arms, the state and federal laws regarding the ineligibility of firearm possession, transportation or ownership for convicted felons, stands. They are also denied the right to vote in many states and in a underhanded fashion, denied to vote in Federal elections because they are not on the State Registrar of Voters rolls. Nifty trick huh? So much for your argument. In addition, both of these rights have a process for re-obtaining eligibility for both registered firearm ownership and registered voter status yet, they are so cumbersome and costly, that most do not even attempt to do it!

 

The point I'm making here is; one man's "discrimination", is another man's "Legislation" or "Departmental Policy".

 

3. "The government cannot interfere". Once again you are dead wrong. States have tremendous rights as do local jurisdictions. The strongest right they have is that of "uncontested policy". By this I mean that as long as the specific law or policy is not specifically prohibited by law, until such time as a constitutional challenge is brought forth in the court system, the questionable law or policy stands.

 

Personally I see no problem with barring convicted sex offenders as they did in Florida. As a father of 3 sons, I feel the EXACT same way and monitor very closely the local Sheriff's site which discloses such persons and their residences to me. They don't know me, but I know ALL of them.

 

Personally, I feel that sex crimes should be capital crimes, especially those against children. In fact, I would volunteer to be the executioner at a modest fee of $1.00 per execution.

There is a problem with it.

 

 

I have an old friend from high school who had sex with his 16 year-old girl friend (he was 18 and a senior at that time) and because her mother is/was such an outlandish cunt he is now a registered sex offender.

 

So... because he had sex with his girlfriend(who he had been with since he was 17) his life is now ruined.

 

As such, that bullshit rule prevents him from getting a place to live when he essentially did nothing wrong. THIS ALONE IS ENOUGH OF A REASON TO BAR THAT LAW.

 

However, the mere fact that Flordian stupidity is baring some people from being or living in the proximity of churches IS A CONSTITUTIONAL VIOLATION and it WILL BE OVERTURNED.
