Lethalfind Posted March 30, 2006 Author Posted March 30, 2006 Remember the guy who shot two arseholes in Manchester UK? Looks like they have caught him http://www.manchesteronline.co.uk/men/news/s/209/209505_pub_shootings_man_arrested.html So what will this guys punishment be, will the length of his sentence be mitigated at all by the fact he might have saved lives by doing what he did and the two ass holes he shot started the whole mess in a "family pub"? slip_knot Posted March 30, 2006 Posted March 30, 2006 Lethal: So what will this guys punishment be, will the length of his sentence be mitigated at all by the fact he might have saved lives by doing what he did and the two ass holes he shot started the whole mess in a "family pub"? He will probably be given a life sentence, with good behaviour he will probably be out in 8 years. His action didn't actually save lives, as he returned fire after the arseholes had emptied their guns. Anyone they shot was already shot before he opened fire. Of course he has made the country safer, and probably will save lives in the long term as these two jerks can't fool around shooting at people anymore. In France they refer to a crime of passion. Those who commit crimes of passion get a reduced sentence. Thats what this guy could claim in France, but it is not acknowledged in the UK Quote

Thats what this guy could claim in France, but it is not acknowledged in the UK IN the US crime of passion is very different, although I can't address every instance that is called crime of passion, one popular example is you come home and find your partner in bed with the gardner for instance, there just happens to be a loaded gun on the dressor by the door, you are so taken aback at seeing your loved one fucking the brains out of the gardner that you pick up the gun and blast them both...no premedetation there. slip_knot Posted April 1, 2006 Posted April 1, 2006 Yes Lethal, that sounds identical to the French crime of passion reasoning. Its understandable too. If a drunk runs down your kid in front of you, I can see how anyone would lose control and do something they would not ordinarily do. As you say there is no premeditation. Coming back to the guy in Manchester, he must have been outraged at those two jerks, with good reason. His mother , wife and kids might have been in there. The closest thing we have is an agrivated assault, I'm not sure if his solicitor can pull this off though An aggravated assault is where, for example X haarasses/assaults/slanders Z, who in turn assaults X Quote
